Terms and Conditions

Your participation in the Referral and Rewards Program (the “Program”) signifies that you agree to these Terms & Conditions, which are final and binding in all respects:


  1. Eligible Participants. All Program participants (‘members”) shall be individual Escalante Club members in good standing. Entity members, such as corporations, partnerships and other entities or associations are not eligible to participate in this Program.


  1. Earning Points. Escalante will credit a member’s account with one “point” for each dollar of an initiation fee received by the Club from a non-member individual who joins an Escalante Club as the direct result of a member’s referral. If an individual joins after being referred by more than one member, the points will be allocated among the referring members.


  1. Exchanging Points for Rewards. Points are void other than for use in exchange for Program Rewards in accordance with these Terms and Conditions. Points cannot be exchanged for cash. Escalante shall periodically publish a list of the items for which a Participant may exchange points and the points required for such exchange. Prior to requesting an exchange, the member must have accumulated points equal to or greater than the number of points required for the requested Reward. If the member has more points than the number required for the Reward, the number of points required for the Reward will be deducted from the member's accumulated points. All points must be redeemed through the General Manager (or designee) of the member’s Escalante home Club. Upon a member’s request for a Reward, the General Manager will verify the member’s eligibility as a member in good standing of the Escalante Club, and forward the request to Escalante’s corporate office. Escalante corporate office personnel will facilitate the Reward by arranging the airline reservations and travel itinerary.


  1. Reward Recipients. When submitted to the General Manager, each point redemption request must identify the Reward recipients (the individual(s) participating in the Reward). Members are not allowed to submit a request for point redemption where the Reward recipient(s) is/are not identified or is/are “to be identified”. For example, members are not allowed to submit a request for point redemption where the recipient is based upon a later event, such as a contest winner or charity auction bidder. Once issued, Reward designees cannot be changed. Reward travel must be complete within one year from point redemption.


  1. Points Non-Transferable. Points are not transferable - through barter, exchange or gift, or through operation of law, such as a transfer through a domestic relations order. Any transfer or attempted transfer will render void the points transferred or subject to transfer.


  1. Account Termination. If a member fails to use the Club for twenty-four (24) consecutive months, even if the member continues to pay dues, Escalante reserves the right to terminate the member’s Program account without notice. In such event all accumulated points (if any) shall be rendered void.


  1. Escalante Release. Each member agrees to release and hold harmless Escalante, its parent(s), subsidiaries, affiliates, employees, officers, directors, shareholders and agents (collectively the “Released Parties”), and indemnify them from and against any and all claims, actions and/or liability for any loss or damage of any kind arising from or in connection with participation in the Program or the redemption and use of points and from liability for the quality or delivery of any goods and/or services provided other companies, such as travel, lodging and other services.


  1. Tax Consequences. Any federal, state and local income taxes resulting as a consequence of participation in this Program or as the result of exchanging points for travel, lodging or others services are the responsibility of the member. Each Member is responsible for reporting and paying all applicable taxes (if any).


  1. Applicable Law. The Program is governed by and to be interpreted in accordance with the laws of the State of Texas. To the full extent allowed by law, these Terms and Conditions disclaim any duty of good faith and fair dealing as well as any implied contractual terms or obligations.


  1. Program Changes. Escalante may, in its discretion, change the Program rules, Rewards and offers at any time with or without notice. In accumulating point or Rewards, members may not rely upon the continued availability of any Reward. Any Reward may be withdrawn or subject to an increase in points required or new restrictions at any time.
